FAIRLYLET – TENANT QUALIFICATION & PROPERTY SOURCING TERMS

Terms for prospective tenants using Fairlylet’s qualification, database and property-sourcing service in England

Effective date: 12 October 2026 | Version 1.1

1. Parties and status

These Terms are between you (the prospective tenant) and Hal Kingsland, a sole trader. Fairlylet is a trading name of Hal Kingsland, a sole trader (“Fairlylet”, “we”, “us”, “our”). Hal Kingsland is a member of the Property Redress Scheme (membership number PRS061274). Membership started on 12 October 2026 and expires on 11 October 2027. Membership of the Property Redress Scheme does not mean that the scheme guarantees, endorses or approves Fairlylet’s services. Fairlylet maintains an active insurance policy. Fairlylet is not a limited company. Business contact email: hello@fairlylet.co.uk. Business correspondence address: Cockles House, Clapwater, Fletching, Uckfield, East Sussex, TN22 3YA.

By ticking the acceptance box and submitting your qualification, you confirm that you have read and agree to these Terms. These Terms govern Fairlylet’s service to you; they are not a tenancy agreement and do not create a tenancy.

2. Current core service

Fairlylet’s current service is to receive prospective-tenant requirements, carry out an initial qualification assessment, maintain an appropriate tenant record, look for or identify potentially suitable rental properties, and facilitate introductions or communications with landlords where a potential match exists.

  • The tenant-facing qualification and matching service is currently free of charge.
  • Qualification means only that Fairlylet considers the information supplied sufficient for its matching process. It is not approval for any particular property.
  • Fairlylet does not guarantee that a property will be found, that a landlord will accept you, that a tenancy will be offered, or that any property will remain available.
  • A landlord may apply lawful, property-specific criteria and may require further referencing, affordability evidence or other checks before making a decision.
  • Fairlylet is not your landlord and, unless expressly agreed in writing for a particular service, does not manage the property, collect rent or deposits, or make the landlord’s final tenancy decision.

3. Information you provide

You must provide information that is accurate and complete to the best of your knowledge and promptly tell Fairlylet if material information changes while you remain active in the matching service.

Initial qualification may include your identity/contact details, property requirements, household requirements, employment status, approximate affordability/income information, current renting circumstances and other information reasonably necessary to assess potential matches. Fairlylet will seek to minimise collection and will not routinely request passports, bank statements, detailed immigration evidence or other high-risk documents merely to join the general database.

4. Qualification, database status and matching

Fairlylet may accept, pause, decline or request further information for a qualification. A decision not to place or keep you on the active database does not determine your legal eligibility to rent.

If qualified, Fairlylet may retain your relevant contact details, requirements and qualification information while you are actively seeking accommodation, subject to the Privacy Notice and retention schedule. You may tell us at any time that you are no longer looking. Fairlylet may periodically ask you to confirm that your information and search remain current.

5. Property introductions and landlord decisions

Where Fairlylet identifies a potential property, we may contact you before sharing detailed identifying or qualification information with the relevant landlord. Only information reasonably necessary for the particular application or introduction should be shared.

Landlords remain responsible for their own property, lawful selection criteria, statutory obligations and final decision. Fairlylet does not warrant information supplied by a landlord and you should satisfy yourself about the property and tenancy terms before entering into a tenancy.

6. Fees and payments

Fairlylet does not currently charge prospective tenants for qualification or for the landlord-facing letting work described in these Terms. Nothing in these Terms requires you to make a prohibited payment or enter into a prohibited third-party service contract in connection with a tenancy.

If Fairlylet ever offers a genuinely separate tenant-only property-sourcing service for a fee, it will only be offered under separate written terms after Fairlylet has checked that the arrangement is lawful for that transaction. No such fee is authorised by these Terms.

7. Optional later-stage services

The following services are not automatically included. A service applies only if Fairlylet expressly confirms in writing that it is being provided for a particular property/application. Additional information and separate notices or authorisations may be required.

7.1 Referencing and affordability evidence

If a property application progresses, Fairlylet may assist with or coordinate referencing, employment/income evidence, rental history, guarantor information or third-party referencing. The scope, recipients and data handling will be explained at that stage. Fairlylet will not guarantee the outcome of a reference.

7.2 Right to Rent – assistance only by default

Fairlylet’s default role is administrative assistance with the Right to Rent process. Legal responsibility for completing the prescribed checks and establishing a statutory excuse remains with the landlord. Fairlylet does not accept transfer of responsibility for initial or follow-up Right to Rent checks under these Terms. Any future appointment of Fairlylet to take legal responsibility for such checks must be made by a separate express written agreement with the landlord identifying the checks, follow-up responsibility and timescales.

7.3 Tenancy documentation, inventory, viewings and management

Fairlylet may later offer administrative assistance with tenancy documentation, inventories, viewings, renewals, maintenance coordination or property management. Those services apply only when separately instructed. The landlord remains responsible for obligations that the law places on the landlord unless the law permits delegation and Fairlylet expressly accepts the delegated task.

7.4 Client money, rent and deposits

Fairlylet does not currently collect rent, tenancy deposits, holding deposits or other client money. You must not send money to Fairlylet unless we have expressly confirmed a lawful payment process in writing. If Fairlylet begins holding client money in future, it will first implement the legally required client-money protections and procedures applicable to that activity.

8. Data protection and privacy

For Fairlylet’s own tenant database, qualification and matching activities, Fairlylet will normally determine why and how personal information is used and will act as a data controller. A landlord receiving your information for a property application will generally have their own data-protection responsibilities and may act as an independent controller; the precise roles may differ where the parties jointly determine a processing activity.

How Fairlylet collects, uses, shares, retains and protects personal information, the applicable lawful bases, and your data-protection rights are explained in the Fairlylet Privacy Notice. The Privacy Notice is not incorporated as a contractual promise where the law treats it as a transparency notice, but Fairlylet will process personal data in accordance with applicable data-protection law.

Service communications about your qualification, property matches or an application are not the same as optional direct marketing. Fairlylet will not treat acceptance of these Terms as consent to unrelated electronic marketing.

9. Equality, fair treatment and unlawful discrimination

Fairlylet will not knowingly apply unlawful discriminatory criteria. Right to Rent checks, where applicable, must be approached consistently for all relevant adult occupiers regardless of perceived nationality. Landlord instructions that appear unlawful may be refused.

10. Complaints

Complaints should first be sent to hello@fairlylet.co.uk. Fairlylet will maintain and follow an internal complaints process and will respond to complaints within a reasonable timeframe. Unresolved eligible complaints may be referred to the Property Redress Scheme in accordance with the scheme’s rules and Fairlylet’s complaints procedure. Nothing in these Terms limits any statutory right or external complaint or enforcement route available to you.

11. Liability and limits

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, or any statutory rights that cannot lawfully be excluded.

Subject to that, Fairlylet is not responsible for a landlord’s decision, a property being withdrawn, inaccurate information supplied by a third party that Fairlylet could not reasonably have identified as inaccurate, or losses caused by your failure to provide accurate or timely information. Fairlylet does not provide legal, tax, financial, immigration, surveying or building-safety advice.

12. Ending the service

You may stop using Fairlylet’s matching service at any time by contacting us. Fairlylet may suspend or end the service where information is materially inaccurate, the service is misused, a request would require unlawful conduct, or Fairlylet reasonably decides it cannot continue the relationship. Ending the service does not require immediate deletion of every record where Fairlylet has a separate lawful reason to retain a limited record, as explained in the Privacy Notice.

13. Changes to these Terms

Fairlylet may update these Terms for future use. Material changes affecting an active qualification or application will be communicated where appropriate. The version accepted at submission should be recorded with the date/time of acceptance.

14. Governing law

These Terms and any non-contractual obligations arising from them are governed by the law of England and Wales. Nothing in this clause removes any mandatory consumer right to bring proceedings in another court where applicable.

15. Online acceptance record
