Landlord Services Agreement
Individual letting and property support services in England
Version 2.2
Dated 12 October 2026
Hal Kingsland, sole trader trading as Fairlylet
1 Parties and documents
This agreement is between Hal Kingsland, sole trader trading as Fairlylet (we or us), and the landlord named in the Service Order (you). Fairlylet is not a limited company. Contact email: hello@fairlylet.co.uk. Business correspondence address: Cockles House, Clapwater, Fletching, Uckfield, East Sussex, TN22 3YA.
This agreement sets the terms on which you may instruct individual services. It comprises these terms, the accepted Service Order, the applicable fee schedule and any agreed written variation. A specific Service Order prevails for its service if there is a conflict, subject to mandatory law and your statutory rights. Signing this framework alone does not order any service or create a monthly charge.
2 Individual services and appointment
Services are supplied only when individually requested and accepted under clause 3. Selecting services on the website or sending an enquiry is a request for assessment, not a purchase, binding instruction or general management appointment. No tenant sourcing or other service is automatically active.
Each accepted Service Order identifies the property, service, deliverables, fee, timing, authority and limits. Buying an inspection, maintenance coordination or another individual service does not appoint Fairlylet as the general managing agent or require us to perform other work. There is no monthly management subscription or percentage management charge under this agreement.
You remain the property's day-to-day management contact unless a Service Order expressly identifies a limited alternative arrangement. You must give occupiers clear contact details for routine management and emergencies and explain any temporary role assigned to Fairlylet.
3 Requests assessment acceptance and payment
The process is request, assessment, written offer, your acceptance and payment, then performance. We may decline a request before it is accepted, including because of location, availability, access, competence, complexity, unlawful instructions or unavailable professionals. A previous Service Order does not oblige us to accept a later request.
Before requesting payment we will assess whether we can reasonably fulfil the proposed instruction. We will confirm the scope, exclusions, total Fairlylet fee, third-party costs or how they will be established, proposed timing and relevant access arrangements. We do not promise that circumstances cannot subsequently change.
Unless the Service Order states another clear formation process, our written confirmation is an offer, valid until its stated expiry. The individual service contract forms when you accept that offer in writing and pay the required Fairlylet fee. We will acknowledge the booking and supply the terms and order in a form you can keep. Payment alone for an unaccepted request does not authorise work and will be returned.
Small fixed-fee support services are payable before work begins, after assessment and confirmation. Letting services and larger projects use the payment trigger or milestones expressly stated in their Service Order. We will not start during an applicable consumer cancellation period without the express request described in clause 21.
4 Service scope and additional work
Fees purchase the agreed work and deliverables, not a guaranteed tenant, repaired property, successful compliance inspection, recovered arrears or resolved dispute. We must nevertheless perform the agreed service with reasonable care and skill and within the agreed time, or a reasonable time where none is fixed.
Each order must identify any material limits, such as number of visits, quotations, follow-ups, duration of case support, or contractor appointments. We will not silently treat a standard fee as covering an unlimited case or charge extra afterwards. If the work exceeds the confirmed scope, we will explain why and obtain your written agreement to additional scope and a price before doing additional paid work. You may decline it, subject to payment for work already properly performed and your cancellation rights.
Purchasing both a basic service and its report enhancement is one instruction. We will not charge twice for the same work or charge separately for routine calls and emails included in an agreed task.
5 Tenant sourcing advertising and viewings
Where selected, we will obtain lawful property and applicant criteria, seek or identify prospective tenants, communicate potential matches, make introductions and keep reasonable instruction and introduction records. Advertising platforms, listing duration, photography, viewings and any third-party charges must be expressly identified in the order; they are not assumed included.
You must supply accurate property details and authorise marketing. You warrant that supplied photographs, floorplans and other materials may lawfully be used. We may edit presentation and correct compliance issues, seeking your approval of material factual claims where appropriate.
The order must state whether tenant sourcing is introduction-only, multi-agency or sole agency, its duration, exact fee trigger and any cancellation or post-termination introduction fee. There is no exclusivity or post-termination introduction fee unless expressly and transparently agreed. You make the final tenancy decision. No tenant, letting deadline, occupancy level, rent payment, conduct or investment return is guaranteed.
6 Referencing and tenant qualification
Referencing or qualification is included only when selected. The order must say which checks we conduct, which are performed by a third-party provider, and what information or report you receive. Provider fees, terms and relevant data arrangements must be disclosed before instruction. References and affordability checks are assessments of available information, not guarantees of future payment or conduct. You remain responsible for the final decision and any further enquiries reasonably required.
7 Tenancy setup and administration
Tenancy documentation, move-in coordination, changes of occupier and other administration apply only when selected and precisely described. We may use suitable templates or coordinate a qualified adviser. We do not provide legal advice, determine disputed legal rights or guarantee that a supplied template fits unusual circumstances.
We have no authority to sign a tenancy, vary its terms, accept a surrender, agree a rent increase, serve a statutory notice or bind you to any legal commitment unless expressly authorised in writing and within our competence and the law. Any proposed change must comply with the law in force; a fixed-term renewal must not be assumed appropriate for a tenancy operating under a periodic regime.
8 Routine property inspections
A Fairlylet routine inspection is a visual visit to reasonably accessible areas to record general condition and apparent maintenance or tenancy concerns, with a brief written summary. The detailed report enhancement adds a fuller written and photographic record, where photography is lawful and appropriate. The order identifies access, extent and any limitations.
This is not a structural or building survey, valuation, invasive investigation, gas or electrical inspection, safety certification, or assurance that all defects, hazards or breaches will be found. We do not test specialist installations or move heavy furniture. Apparent urgent concerns will be reported promptly and specialist advice recommended where appropriate. You remain responsible for arranging necessary action.
9 Maintenance coordination
Routine maintenance coordination covers assessment of the reported issue for coordination purposes, communication with you and the occupier, contacting an appropriate contractor, coordinating approved appointments and access, updating you and following up the instructed work within the agreed scope. The standard fee applies to one routine issue, with any material task limits confirmed before payment. Major or complex projects require a separate quotation.
We do not personally carry out repairs or certify workmanship unless separately agreed for work within our competence. Coordination does not guarantee contractor availability, repair success, cost, parts availability or completion by a deadline outside our control. We will act with reasonable care in selecting and coordinating professionals and disclose known problems promptly; these limitations do not excuse a failure to perform our own obligations.
Fairlylet does not offer a 24-hour or emergency response service under this launch agreement. Do not use the website enquiry form for an emergency. You must maintain and communicate an appropriate emergency arrangement. Receiving a report outside an accepted order does not automatically activate a paid coordination service. If we see an urgent safety concern, we will take reasonable steps to bring it to the relevant person's attention within our role; nothing excludes duties imposed by law.
10 Compliance and specialist appointment coordination
Compliance coordination means arranging the particular professional appointment and related administration identified in the order. It does not include the professional's inspection, certificate or report fee, ongoing compliance monitoring, automatic certificate renewals, or a promise that the property will pass.
Gas, electrical, energy, structural and other specialist work must be performed by a suitably qualified and, where required, registered professional. We will use reasonable care to check appropriate credentials for work we arrange. The professional performs and is responsible for their work, subject to their own contract. You retain the underlying statutory duties except to the extent the law and an express written appointment validly allocate a duty otherwise. A coordination order does not appoint Fairlylet to assume gas-safety duties or other statutory responsibility.
Arranging inventories, specialist surveys or other professional appointments must have a separately agreed coordination scope and fee if not covered by a published service. You approve the professional and their price before instruction.
11 Tenant issues and arrears assistance
Tenant issue support covers administrative communication, recording the reported problem, seeking relevant information and reporting practical next steps within the agreed case scope. It is not formal mediation, adjudication, legal advice or a guarantee that the issue will be resolved. Matters beyond our competence will be referred to an appropriate adviser.
Rent arrears assistance relies on payment information supplied by you. It covers agreed administrative contact and record keeping, not rent collection, debt recovery litigation, guaranteed recovery or continuous payment monitoring. You must keep accurate rent records and notify us of relevant receipts. Possession proceedings, formal enforcement and legal representation are outside this agreement.
12 Check out and end of tenancy
Check-out coordination covers the agreed arrangements for the end-of-tenancy visit, access, key return and communication. A detailed condition report is a separately selected enhancement and compares available condition evidence with the original inventory where supplied. Without reliable original evidence, the report will state its limitations.
The order identifies who attends and whether an independent clerk is involved. Independent professional fees are separate. We do not decide disputed deductions, guarantee a deposit award, determine whether a tenancy has legally ended, accept surrender or handle deposit money. You retain responsibility for lawful notices, possession, deposit decisions, protection and repayment. Cleaning, repairs and reletting are separate instructions.
13 Written access authority and keys
You authorise Fairlylet in writing, only where reasonably necessary to perform an accepted service, to arrange access to and attend the property on your behalf and arrange access for appropriately appointed contractors or professionals within the order. This includes written authorisation for viewing condition and state of repair under section 11(6) of the Landlord and Tenant Act 1985 where applicable. It is not unrestricted permission to enter.
Access must comply with the tenancy, occupier rights, applicable law and any applicable professional code. For ordinary occupied-property visits we will give at least 24 hours' written notice where required, arrange a reasonable time and obtain the occupier's express agreement before entering. Notice alone is not permission to use keys against an occupier's refusal. We will not force entry or treat silence as consent. If access is refused we will notify you and seek lawful next steps; we will not determine or enforce disputed entry rights.
Only a genuine emergency and a lawful basis can justify departure from normal access arrangements. This does not create an emergency attendance service. Possession of keys does not expand our authority. Key receipt, storage, authorised use, release and return must be recorded; keys will be safeguarded and released only to authorised persons for an agreed purpose.
If access fails, we will discuss rescheduling. There is no automatic failed-visit fee. Any such charge must have been expressly agreed, be reasonable and reflect justified loss after mitigation, subject to statutory cancellation rights. We will not charge you for a failed visit caused by our own fault.
14 Contractors professionals and expenditure
Fairlylet's fee pays for our work. Contractor and independent professional charges are separate and normally paid directly by you to the supplier. We will disclose known fees, estimates, VAT and payment terms and obtain approval before appointment. Where a cost cannot yet be established, we will explain the calculation or obtain a quotation; we will not present an unknown cost as included.
Unless otherwise expressly agreed in writing, the supplier contracts with you and invoices you directly; we coordinate as your disclosed agent within the accepted order. We have no general authority to incur expenditure, approve variations or commission work. Any delegated authority must specify the supplier, work and maximum expenditure in pounds including applicable VAT. No expenditure beyond that authority may be committed without further approval.
We do not take advance repair budgets or professional fees into our account. Any referral fee, commission or supplier relationship material to your decision will be disclosed before instruction. We remain responsible for reasonable care in our own selection and coordination; third-party status does not exclude that responsibility.
15 Landlord responsibilities and lawful instructions
You confirm that you are entitled to let and instruct services for the property, have any required lender, superior-landlord, insurer or other consent, and supply accurate, complete information. You remain responsible for property condition, repair, licensing, gas and electrical safety, smoke and carbon-monoxide requirements, energy performance, required tenancy information, deposit protection, tax and other applicable landlord duties except to the extent of a valid express allocation under law.
You must respond promptly to approvals, provide relevant documents, arrange lawful access and act on urgent concerns. Delegating administration does not remove a statutory duty that remains yours. Nothing in this agreement removes any duty imposed directly on Fairlylet by law.
Applicant criteria must be lawful, relevant and fairly applied. You must not instruct unlawful discrimination, prohibited tenant payments, unlawful rental bidding, harassment, unlawful eviction or misleading advertising. We may refuse or stop work requiring unlawful conduct. Right to Rent procedures must be applied consistently without discrimination.
16 Right to Rent assistance
Right to Rent assistance is administrative support with the Right to Rent process. Legal responsibility for completing the prescribed checks and establishing a statutory excuse remains with the landlord.
This includes the landlord's responsibility for applicable initial and follow-up checks, timing and legally required evidence retention. Providing document administration, reminders or communication does not by itself transfer civil-penalty responsibility to Fairlylet. Any future transfer of responsibility requires a separate express written appointment setting out the checks, duties, timing, reporting and retention, and will be accepted only where lawful and operationally supported. No such transfer is made by this agreement or the dashboard.
17 Fees VAT and publication
The agreed service price and charging unit must be stated in the order. Current support fees are in Schedule 1. Fairlylet is currently not VAT-registered and does not charge VAT. Displayed current fees are the total Fairlylet charges for the stated service, excluding clearly disclosed third-party costs.
An accepted order's total price will not be increased merely because Fairlylet later registers for VAT. Future orders will show the applicable total price and VAT position before acceptance. We will publish relevant fees and legally required information and identify the service, unit, inclusions and any calculation method where a fee cannot reasonably be established in advance. No hidden administration or payment charge is added.
The tenant qualification and matching service is free to tenants. You must not pass our fees or prohibited third-party charges to a tenant, applicant or guarantor or require a prohibited service contract or loan. Any permitted tenant payment must comply with applicable law.
18 Rent deposits and other client money
Tenants pay rent directly to you. You receive and lawfully deal with holding and tenancy deposits. Fairlylet does not collect rent, receive or protect deposits, hold repair budgets, or receive money intended for contractors or professionals under this model. Payment of our own agreed service fee is distinct from these third-party funds.
Do not direct anyone to send client money to Fairlylet. A future client-money service would require a separate agreement and all legally required protection, accounts, publication and procedures before activation; it is outside this agreement.
19 Personal data and records
Fairlylet acts as a controller for the purposes it independently determines for its tenant database, qualification, matching and service records. You ordinarily act as a separate controller when receiving information for your tenancy decisions and legal duties. Roles depend on actual processing, not labels. Where we jointly determine purposes and essential means, an appropriate joint-controller arrangement must be documented; processing solely on documented instructions requires appropriate processor terms before it starts.
Only relevant, necessary applicant and property information will be collected or shared. You must not require excessive or discriminatory information. Special-category or criminal-offence data requires an identified lawful basis, additional condition and safeguards before collection. You must keep shared records secure, restrict access, use them for legitimate letting purposes, meet transparency and rights obligations and promptly tell us of a relevant breach or rights request.
Fairlylet uses Supabase for tenant records under its applicable data arrangements andPrivacy Notice. Access by you is limited to records lawfully relevant to your property and authorised role, not the general tenant database. Retention and deletion follow the current Data Processing and Lawful Basis Register and Retention and Deletion Schedule; deleted records may remain in backups for up to 30 days, subject to documented legal holds and backup arrangements. You must maintain your own lawful retention schedule. Signing this agreement is not blanket consent to personal-data processing or marketing.
20 Delay inability to perform and remedies
We will tell you promptly if an accepted service cannot proceed or is materially delayed, explain the reason and offer reasonable next steps. A materially different service, substitute provider, increased price or revised completion date requires your agreement; it will not be imposed automatically.
If we cannot provide an agreed service, you may accept a suitable alternative or cancel the affected instruction. If none of that service has been performed, its Fairlylet fee will be refunded in full. Where a separately identifiable part has been properly performed and remains useful, any amount retained must be reasonable and proportionate to that part. If the essential agreed deliverable cannot be supplied and partial work has no useful value, we will not retain a fee merely because time has been spent. Statutory remedies for our breach or defective work remain available.
Supplier delay or access difficulty does not automatically mean coordination has not been performed, but we must fulfil the agreed coordination scope with reasonable care. We will explain work completed and any unresolved steps. No blanket non-refundable fee applies. Refunds will be made promptly and, where law requires, within 14 days using the original payment method unless you agree otherwise, without a refund fee.
21 Cancellation and early performance
Where you contract as a consumer at a distance or off premises and a statutory cancellation right applies, you may cancel within 14 days after the day the relevant contract is made, without giving a reason. Consumer status depends on the circumstances; being a landlord does not automatically decide it. Mandatory extended cancellation rights apply if required information was not provided.
We will supply required pre-contract information and a copy of the contract and cancellation instructions in a durable form. You may cancel by an unequivocal statement to hello@fairlylet.co.uk or our stated correspondence address, or use Schedule 3. Sending the notice before the cancellation deadline is sufficient. If the framework itself carries a cancellation right, cancellation of it will not remove rights relating to individual orders; each order will identify its own cancellation position.
We will normally wait until the cancellation period has expired. If you want earlier performance, you must expressly request it, separately from accepting these terms. For an off-premises contract the request must be on a durable medium. We will explain that if you cancel after a valid early-start request you may owe a proportionate amount for the service supplied before cancellation, calculated against the agreed price, only where the law permits and the required information was supplied.
The cancellation right is lost through full performance only where you expressly requested early performance and acknowledged beforehand that you would lose that right once the service was fully performed. Payment or a pre-ticked box is not sufficient. An early-start request does not remove other statutory remedies.
For cancellation outside a statutory cooling-off right, you may stop future work by written notice. We will retain only the reasonable value of properly performed work and any expressly agreed, lawful, unavoidable cancellation cost, allowing for savings and mitigation. Any further charge must be evidenced and not exceed the agreed fee for the cancelled instruction. Third-party cancellation terms must have been disclosed and approved and are dealt with under your supplier contract; we will reasonably help communicate cancellation.
22 Term termination and handover
The framework starts when signed and either party may end it by written notice. Each service ends when its agreed work is complete unless the order states a defined duration. Ending the framework does not automatically cancel an existing order; identify the orders you wish to cancel, which are then dealt with under clauses 20 and 21. There is no automatic renewal or continuing management duty.
We may stop or terminate affected work for unlawful instructions, serious abuse, material misrepresentation, non-payment or a material safety or compliance risk, explaining the reason where appropriate. We will give a reasonable opportunity to remedy a remediable breach where practicable. Fees and refunds will reflect lawful, properly performed work rather than an automatic forfeiture of prepayments.
On ending an instruction we will identify outstanding matters, return keys and provide agreed records securely, subject to lawful retention and third-party rights. Neither termination nor unpaid fees justify withholding information needed to address an immediate safety risk. Accrued rights, complaints and data-protection obligations continue where applicable.
23 Insurance liability and advice
You remain responsible for appropriate landlord and property insurance and disclosure to your insurer. Fairlylet maintains active business insurance, including professional indemnity and public liability cover, appropriate to its current insured activities. Cover remains subject to the terms, conditions, limits, exclusions and period of the applicable policy. Fairlylet will not claim insurance cover, qualifications or accreditations that are not in force.
We remain liable for our own breach, negligence and failure to exercise reasonable care and skill. We do not guarantee tenants, specialist outcomes or third-party information we could not reasonably identify as inaccurate. Nothing excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot lawfully be excluded. No artificial financial cap or blanket landlord indemnity is imposed.
You remain responsible for your own breaches and retained obligations, subject to applicable law and causation. This does not make you responsible for our fault. We do not offer legal, tax, financial, immigration, structural surveying or other specialist professional advice under this agreement. No partnership, employment or joint venture is created.
24 Complaints notices and governing law
Send complaints to hello@fairlylet.co.uk or to Fairlylet at Cockles House, Clapwater, Fletching, Uckfield, East Sussex, TN22 3YA. We will acknowledge, investigate and respond under ourComplaints Procedure. Hal Kingsland is a member of the Property Redress Scheme (membership number PRS061274), with the current membership period running from 12 October 2026 to 11 October 2027. If an eligible complaint remains unresolved, it may be referred to the Property Redress Scheme in accordance with the scheme's rules and ourComplaints Procedure. Membership does not mean that the scheme endorses, approves or guarantees Fairlylet's services. Nothing restricts statutory rights or any regulatory, redress or court route that applies.
Ordinary instructions may be recorded by email. Material changes require written agreement; website edits do not retrospectively vary an accepted order. This agreement is governed by the law of England and Wales. The courts of England and Wales have jurisdiction subject to any mandatory consumer jurisdiction rights. Parties may seek informal resolution without being obliged to give up urgent remedies or statutory deadlines.
